If you win your appeal, you will receive payments even if your former employer appeals the decision. If the final decision at the appeal if not in your favor, you will have to pay back the benefits you received since the appeal. The Referee’s letter will be sent to the Administrator who will advise you of the overpayment amount and the method to repay. If your fail to make the repayment schedule, you may find your wages attached by the Administrator. You can appeal the repayment schedule but only the payment, not the fact that you do not feel you should have to pay back the benefit.
